Major League Baseball sticks it to NoMaas

A few days ago, we were contacted by Zazzle, which is the company that handles the manufacturing and shipping of our T-shirts.

Zazzle informed us that all of our T-shirts were being removed (except the NoMaas.org one) because Major League Baseball contacted them and stated we were infringing on their intellectual property rights:

We have been contacted by counsel from Major League Baseball Properties, Inc., and at their request, have removed the products from the Zazzle Marketplace.

While our shirts had no player last names or player images, apparently MLB owns the rights to numeric symbols and letters of the alphabet. We protested to Zazzle, but to no avail.

If you have one of these shirts already, you're now in possession of a limited edition piece.

    Anyone with a law background? I’ve seen the NoMaas Zazzle shirts before and in my untrained opinion I don’t see anything there that falls under the auspices of MLB IP.

    I would have thought RUN DMC and AC/DC would have bigger gripes than MLB. I could see those as logo infringement.

    But I don’t see how MLB has a leg to stand on for those 2 shirts at least.

    Not for nothing, but the yankees probably actually own a copyright on the phrase “Yankee Universe”. I am not saying it’s not petty for them to crack down on a fan blog, it is. But they have a case at least.

    Problem is that MLB isn’t threatening NoMaas, it’s threatening Zazzle, and if NoMaas uses a different shirt company, MLB will threaten it too. Since $$$ of hiring lawyers to deal with threats of litigation by MLB > $$$ made by filling shirt orders from NoMaas, MLB will always win here.

    The potential lawsuit is not against NoMaas — it’s against Zazzle. MLB probably went through various online stores and thought “hey, we could be losing money here.” They then threatened Zazzle to remove the products or face a lawsuit. Zazzle probably said “fuck this, we aren’t going head to head with MLB” and removed all of the products.

    NoMaas can go elsewhere and sell their t-shirts. At that point, if MLB cares, they’ll threaten that distributor too. But NoMaas was never in any legal danger here.

    The easy answer is, it doesn’t matter.

    MLB has shown itself it be aggressive in defending its copyrights. The cost of defending against such a suit from MLB would far exceed the $$$ amount that NoMaas or any clothing manufacturer would make selling the shirts. So even if you fight MLB and win…you still lose.
